22nd issue of the Debates and Documents collection

The Foundation is pleased to announce the release of a new issue of its Debates and Documents Collection available in open access.

This essay by Prof. Koncewicz argues that the so-called reform of the Polish judicial system has triggered a paradigm shift in the case law of the European Court of Justice. In response to referrals from Polish courts and in ruling on infringement actions brought by the Commission, the Court of Justice has been taken to task and has remained true to its mandate; in the words of former Court judge C. Kakouris: its “mission” is to ensure “supranational legality” in the field of application and interpretation of EU law.

Professor Tomasz Tadeusz Koncewicz holds law degrees from the universities of Wrocław (Poland) and Edinburgh (Scotland). He heads the Department of European Law and Comparative Legal Studies at the University of Gdańsk in Poland.
